Terms of Use

By accessing or using the Performance Horses marketplace ("the Platform"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform following the posting of changes constitutes your acceptance of those changes.

Performance Horses is a listing marketplace that connects buyers and sellers of performance horses. We do not take possession of, or assume responsibility for, any horse listed on the Platform. All transactions are conducted directly between buyers and sellers.

Sellers are responsible for the accuracy of all information provided in their listings, including but not limited to horse specifications, pedigree, health records, training history, and pricing. Misrepresentation of a horse is a violation of these Terms and may result in account suspension.

Buyers are encouraged to conduct independent due diligence, including pre-purchase examinations, before completing any transaction. Performance Horses does not guarantee the condition, soundness, or suitability of any horse listed on the Platform.

Sellers are charged a one-time listing activation fee per horse. Optional visibility upgrades (Featured, Spotlight, Re-feature) and professional directory advertising are available for additional fees as described on the Platform.

All fees are processed through our third-party payment processor. By submitting payment, you authorize us to charge the applicable fee to your payment method. Fees are non-refundable except as required by applicable law.

Performance Horses does not process or facilitate the payment for horse purchases. All horse sale transactions occur directly between buyer and seller outside the Platform.

You agree not to use the Platform to post false, misleading, or fraudulent listings; to harass, threaten, or harm other users; to scrape, copy, or redistribute Platform content without authorization; or to circumvent any security or access controls.

All buyer-seller communications must occur through the Platform's secure messaging system. Sharing personal contact information in public listing fields is prohibited.

All content on the Platform, including text, graphics, logos, and software, is the property of Performance Horses or its content suppliers and is protected by applicable intellectual property laws.

By uploading photos, videos, or other content to the Platform, you grant Performance Horses a non-exclusive, royalty-free license to display and use that content in connection with the Platform.

Performance Horses is provided on an "as is" basis. We make no warranties, express or implied, regarding the Platform's availability, accuracy, or fitness for a particular purpose.

To the maximum extent permitted by law, Performance Horses shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any horse transaction facilitated through it.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
